Legalize the illegal construction now by compensating with a Penalty

Daily population growth leads to an increase in the number of buildings, some of which are legal, while mass construction can be considered illegal. To protect their pockets, they did not notice that they were conducting all the unnecessary searches, so they continued to build illegally. 

Poverty, excess housing, and urban urbanization are other significant consequences of illegal construction. The illegal construction of buildings is a severe problem faced by the municipalities and governments of various Indian states.

Although these illegal buildings are prepared using material and cement, many people have participated in constructing such facilities, a part of the corruption and smearing palm for the greed of money. Some officials accepted bribes to carry out the structure of illegal structures.

People often feel that houses are expensive, so they move from one place in the city to another place where they can find cheap homes. When looking for cheap houses, they move to illegal buildings to do their jobs. They put their lives at risk and put the lives of their family members at risk.

But lately, there is good news for the builders who own such properties. Residents of the metropolis breathed a sigh of relief: owners who built buildings on the map have the power to legalize the unlawful facilities by paying fines. With this in mind, the government has approved the Ministry of Development of Ghaziabad to take this initiative.

The GDA vice president said that as part of this capitalization rule, illegal construction could be legalized by paying derogation fees, especially in metropolitan areas with 2,000 property cases under review and have already ordered a review. The study has been confirmed. 

Also becomes mandatory if property and land are incorrectly registered through a power of attorney. A large number of entries on this topic are still awaiting. 

We won’t distress you that the Supreme Court has suspended the mitigation plan from July 15, 2020. But now, the implementation of the mitigation plan of 2010 has paved the way for legalizing illegal buildings.

Although the rules are aiding in clearing the illegal names on the buildings, one must not be a part of illegal construction.

 The supreme courts follow specific guidelines on a particular matter, and here they are:

  1. The Supreme Court ordered the authorities of Maharashtra to map all cities with a population of more than 5 million so that illegal buildings can be easily tracked and controlled.
  1. The right to demolish the illegal properties of the citizens of the country is revised in a completely transparent way.
  1. Renovate cities and demolish illegal buildings.
  1. The rule of law stipulates that illegal buildings must be demolished, and no sympathy for violators is allowed.
  1. If a building is illegal, even if it is illegally demolished, it cannot be rebuilt.
  1. If the municipal organization violates the rule, but the design is entirely illegal, it can be compensated. In the case of compensation, it must be made by the official who broke the law without exception, and it will be confiscated.

How to report an illegal construction?

For the visibility of any illegal construction, you can contact the municipal government to make a complaint appropriately. And then, the municipal company sends a notice to the residents/owners.

The notice is sent as follows:

  1. Issue a notice to the occupants of the illegal building and set a time limit for the reply.
  1. The municipality also allows a person enough time to obtain a moratorium.
  1. If the owner does not take any action, the building is responsible for demolishing.
  1. The government has launched a web portal, using which one can complain about such construction.
  1. Complain to the police and get preventive help

On the other hand, a Municipal organization is established to resolve disputes related to illegal construction. Here the procedure involved in resolving the issue is faster than that in court, and one can call the tribunal by their rules.

The development of resources and time are the subject of litigation. In addition, it has caused flooding, road loss, and the deterioration of the space. In other words, low-quality buildings are a significant threat to the lives and safety of residents. And illegal construction practices are stopped. 

The question now is how to control the spread of illegal construction in industrial cities. In addition to the demolition campaign, the MC and the state government have to improve their laws to launch a legal system to regulate land use. The authorities must implement the use of Google maps for tracking illegal construction in collaboration with the residents.
